Actually California was sued, and lost, and has stopped collecting the fee and is now in the process of giving it back, with interest.

The CA legislature was told the fee was illegal, by their own counsel, and went ahead and imposed it anyway and fought the battle in court. Why not? They didn't have to pay the legal costs or the interest costs or the repayment costs, the people of the state did and nothing was done to those legislators who voted for it.
