Actually, that's not true. They have to take action against known violators or they eventually lose their rights, basically. That's trademark law. This cost is nothing compared to the costs of not having trademark protections at all. But there can be overzealous prosecution and even harassment, and this can be precipitated by the economic self-interest of the firm hired as the guard dog. Funny, but there was a joke about the attorneys out shutting down enthusiast websites on Market Place (NPR) last week. Bottom feeders!
