Please read the owner's manual of the seat again. I believe that you will find that the seat does go to 60 lbs., but the 5 point harness is only rated for 40 lbs! Therefore, for the time between 40 and 60 lbs., you have to remove the 5 point harness and use the seat as a Belt Positioning Booster which requires a real vehicle 3 point shoulder belt in the back seat. Even if you have a rear shoulder belt system, it also requires the child to be mature enough to not remove the vehicle belt or fidget so much that it is improperly placed while travelling.
