VHF is considered 88 to 174MHz - this starts at Broadcast Radio, Air, HAM, then into commercial and marine - there is no real 'free' space other than HAM radio. Here in BC VHF is very commonly used and even though I do not have a commercial licence nobody cares as it is a big safety factor on the logging roads - there are also three "BS" channels that are common 'logging' frequencies that are designed for truck to truck communications. ...and from what I remember, VHF is illegal here in the states on a land based system. I think they are reserved for watercraft and possibly planes. Might be wrong on this, I've been wrong before, but it's a shot.
