You do have some legal recourse for the fix if you get the repair documented especially by a VW dealer. No one likes to take legal action but in your case it was negligent and could have killed you. Don't let them get away without paying for the fix. You might contact them (in writing) to invite their choice for your local fix before you go legal on them but assure them you are aware of your legal rights.
