I went through a similar deal when my 16V Scirocco was hit from behind.


I had spent heaps of money the months prior, and had all the reciepts to prove it.


I went through the New Hampshire Insurance Commision.  They were able to get my settlement within about $1000 of what the vehicle cost to replace.  Instead of the $400 I was going to get.


(at the time it was about a $4000 car)


My lesson was this:  Never leave the accident unless you are in an ambulance.  The sleazy ambulance chaser lawyers are the only ones who will assist you.


It sucks, and is not fair or correct.  But that is how the system works.
