First, how come a new engine was using so much oil it ran out and threw a rod? My AVP rebuild has about 15000 miles on it, and I still don't have to add any oil between changes. Maybe it was just defective and threw the rod. Maybe he didn't run it out of oil at all.

Second, if it was a new engine, why isn't there a warranty on it?
