He could have easily avoided those problems by a) setting a reserve price or starting price that'd recoup his costs or b) when he realized his error in NOT setting the reserve/initial price, he could have cancelled the auction before it ended without penalty, claiming "error in listing" (someone did that to me when I was about to win a set of Vanagon power mirrors for like $15).
