That's (partly) why the fenders get trimmed.

b) attaching issues

I bet pop rivets would do an outstanding job

d) fender cutting issues

Cut-off wheel in a die grinder would make short work of the offending area!

e) rusting issues.

Rust-belt folks ought to know how to handle exposed metal. Isn't that POR-15 stuff for that?

f) VAG issues (copyright & patent) >

You can't copyright a fender flare as it's not a literary, musical, dramatic, or artistic work; there's a hundred-odd years of prior art in fender flaring to invalidate any potential utility patent; design patents only apply to purely ornamental designs-- if it DOES anything (i.e. keeps mud off the sides) it's a utility patent or nothing. I'd say we're pretty safe in regards to f).
