The fix is very easy. Drop a small piece of plastic in the window track up in front. You want to make the piece thick enough to force the window too step up as high as it can, when closing. This make the latch engage more complete. You can also remove the latch and reinstall it on the window as high as possible. You will find that the rubber is causing this to sag. Glue will help this.
