Thermostats can and do fail closed. The air cooled ones used vacuum to pull closed and has a solder type seal that would melt when over heated to fail open. Water cooled thermostats use a "Waxman" to operate. If the wax should leak out which often happens after any overheat it will not open again next time. That is why they should always be replaced after any cooling system failure.

It would be crazy to design such a device that can break in the close position!!! They are design to break in the open position!

That said, i jave seen 1 broken in at 80% close, only one.

So let's say that he has 5-10% chance, that would make more sense.
