I'm an ex lawyer (government prosecutor) and if caught I would argue that an open wireless is not "a computer networks" Furthermore I would argue that the intention of the legislator that passed the law was not to prohibit wireless "stealing" but was to prevent people from trying to hack into * computers* net woks by all means including wifi access. If you use and Internet access point to simply browse the Internet with no arm, you could defend yourself very easily from such accusation. Think about it! if the legislator intention was to prohibit wifi "stealing" it would have been easy to wrote the law accordingly. The fact that he didn't plays on the citizens side.

Oh and since the arrest in 2007 they have been some developments :

WELL, that's pretty screwed up BECAUSE Texas offers free WiFi Internet service in it's own Rest Stops with Tourist info centres ! You do not have to go in and get permission. We used them coming back from Mexico this past Spring. So they are on both sides of the fence ??????? More screwed up laws by screwed up bureaucrats !!
