Is the issue the material or that the system has be tested and proved to be working? I doubt the DMV would require a systems change. It is reasonable that the vapor recovery system is doing what it is intended to do. As quick test, when pulling into a fuel station and opening the filler, do you often hear air escaping? If not than most likely the system needs repair.
