As some others will explain, the engine has to be running so the oil is pushed into the torque converter (centrifugal forces) and other passages and warm to account for thermal expansion. There is little room for overfilling. Once it is filled after a change service any need to top off is a problem.

I wonder if some of you fine folks would be so kind as to go out and check your transmission fluid levels with the drive train stone cold. I'm trying to establish a sort of average frame of reference for what that level would be.
