"Good news" from Mexico on the Tenacatita situation for those of you interested. Me,I'm holding my breath on this one, but it does look as if some sort of justice is in the works. BTW, Rita & I are off on another winter adventure which will eventually lead us to see what is going on down there in Tenacatita up close and personal. We are off with our VW camper, again, November 01, to Florida for a family wedding Nov. 11. We will then spend some time in Florida with family, go to Key West, meet some friends near Tampa then head to Cozumel either by boat if we can or by the long road around. We will stay in Cozumel with friends from here until late January ~ February then head to Bacalar, Puerto Escondido, up the coast to La Manzanilla then to California for April then back home for the end of April. And, yes, there will be a Blog, announcement coming soon. Please pass this news on to anyone you may know who is interested.

Y aparte va a tener que abrir inmediatamente y a restituír todos los daños y perjuicios que ocasionó”. > El abogado agrega que se demanda por la vía penal el resarcimiento de los daños ocasionados. Strange. I'm actually in California and missed the hurricane. I haven't been able to get any information about El Rebalsito or Tenacatita, although the La Manzanilla Message Board has lots of info about La Manz. As for the press conference, there's great news. The magistrados of the Novena Sala Supremo Tribunal de Justicia del Estado wrote an 88 page document/decision about the case. It's definitely not light reading. These are the important points: --The judge in Autlan that ordered the judge in Cihuatlan to carry out the eviction, did not have the legal authority to do that. It would have had to be done by a federal judge, and he wasn't one. --The Supreme Court decision of 1999, that Rodenas was basing his actions on, only applied (legally) to the Sra. Paz Gortazar and not to Rodenas. --The titles signed by Presidents Fox and Calderon are valid. --The land has to be restored to the way it was before the desalojo, and Rodenas has to pay all material damages. The ejido lawyer, Everardo Rojas Contreras said that although Rodenas claimed 42 hectares, he had actually taken possession of 160. Therefore he's filing papers against the governor and the head of state security for not upholding the law. Rodenas has filed an appeal, which will be heard on Oct. 27, but Rojas says there's no grounds for appeal. He expects it might take until the beginning of Dec. to finalize everything, at which point all the fences will come down and people will be able to go back to their homes. Rodenas' concession ends the first week in January and the concession is then supposed to go to the municipal of La Huerta. We don't know what the conditions will be, but I've heard that they're not going to allow restaurants on the beach, that they'll have to be on the other side of the road (the lagoon side). It seems like the real thing this time, since it's a court decision. dobie
