That is the case. And all I'm saying is, that given this from the article:

The EPA in 2009 issued an "endangerment finding" that greenhouse gases "reasonably may be anticipated to endanger public health." The agency followed with the "tailpipe rule" in May 2010 setting limits on greenhouse gas emissions from cars and light trucks.

The door is wide open for all kinds of rulings that may will trickle down and be retroactive to Vanagon owners as the effort increases to get old smokers off the roads. It may not happen, but the door is more open now than ever for it to happen.
