I've been told that the dealers have to pay whomever reclaims the materials, as the cost of reclamation exceeds the money gotten for the stuff. Hence, in most (all?) states, the disposal fee charged with each new tire sold. Of course, if the real objective were to insure proper disposal of tires, then customers would get a credit for turning in an old tire.
