Okay, I'm not an attorney or anything, but isn't the mom responsible for the actions of her kid, who gave the keys to the 16-year old? I'd think about implicating her in small claims court. Insurance company rules don't always jive with what courts see as responsibility. You'll get the minimum from the insurance company until you present a really strong argument and then they'll negotiate.
