There is a difference. I'm not a lawyer and I would think it does not make any difference. However the professional writing people do not agree. Every new publication of a 'work' entitles an author to new royalties. In our country a free lance journalist recently succesfully sued a newspaper for publishing one of his articles on their website. The reasoning here being that his permission to print the article in a newspaper does not automaticcally give the newspaper right to publish it in other media. Now I do think that is stupid (who wants yesterdays news anyway) but this guy found his trade union right behind him. The list CD is a comparable issue. Most contributers will probably have no problem with it. However it only takes one person to get nasty over this to upset the whole organisation of the list. My 2 cents out of a (Dutch) guilder.
