If it is not an external linkage problem then I would suspect that he reused the old assembly. This sounds like the clutch hub is flexing due to cracks and after the inital load is taken off 4th it moves somewhat. When the load is reapplied then the engagement between the slider and the gear teeth are out enough that it 'rolls' off and pops the trans back into neutral.
