James, Have you tried the Better Business Bureau? If they have a clean record there, the shop may want to cooperate. If the shop already has unresolved complaints you may not get anywhere, cuz they don't care about their BBB rating or reputation.

Your best bet is to try and resolve this with them. You are better off if you can negotiate and get part of your money back, than going to court and then trying to collect. Don't be afraid of telling the shop what you expect from them. If you can't do it in person, put it in writing, and demand a response.

Laws vary from state to state, but my experience in small claims taught me that even if you win, you may not be able to collect. Small claims is not free. You pay a filing fee, and then a fee to have the other party served if they refuse the registered letter. If you win, you need to file to have their wages garnished, or property seized, because chances are they won't just hand you the money.

You still need to present a good case in court. How do you plan on refuting the shops claims? You need a statement from another mechanic (much better if you have more than one opinion) to back up your side, or better yet, you need the mechanic to come to court with you.
