You completely missed the point of Todd's post. Todd wasn't giving legal advice. He was merely stating that he missed his opportunity to register volkswerks.com, and suggesting that if you want to register a domain name for your business, do it quickly, or someone else might.

Make sure you completely read the post, before you attack it.

Sorry, but this isn't going to work, especially given the amount of discussion on the VW lists about this, it would be easy for VW to show that individuals had knowlege of VW's intent to enforce its copyrights. At this point, without "knowlege"...ie using a VW trademark in one's domain name prior to the letters going out or the discussion on the net about this issue would make one an "innocent" infringer. An innocent infringer's only duty to the owner of the copyright is to stop the infringement...

With knowlege of the infringement, one becomes an "intentional" infringer, and can be held liable for $$$ damages as well as to stop the infringment.

I hate to say this...but I'm going to...I don't give advice on how to rebuild transaxles...so stop giving legal advice.
