Considering this fact, I would agree, The mechanic is a putz, and (with some luck) you will find another that is more conscientious. Even if you don't make a legal case of it, your buddy ought to at least make the shop manager aware of the failing, and the possible outcomes had circumstance been different.

According to Bentley and my experience, that bolt MUST be loosened to remove the engine. I think the mechanic should be on the hood for this one. Looks like he forgot to tighten or reinstall it when he put the engine back in.
