Someone said the sued on "non-conforming product" law. This is simply a breach of contract theory under the Uniform Commercial Code. If you live anywhere but Louisiana (which uses French Civil Law instead) you probably have this THEORY available. The bigger problem is that the person who posted lived in California, I believe. I assume that GEX is in California. If you do not, you may have to sue GEX in California. The cost of a California lawyer for a few hours work may be more than the engine, and GEX knows that. However, persistence and stubborness sometimes prevails. Make note of the fact that you're posting their product failure on various internet sites, and it may help.
