I have seen weight used as any issue here in Colorado on an accident that I observed (and due to where I was positioned had to sit through). A heavy duty pickup with a heavy load ran into another vehicle doing a very severe job on it. The highway patrol cop called for an enforcement unit with the porta scales. The driver of the truck was then ticketed for about 6 offences relating to unsafe operating and his load. Cop I talked with said the guy was at least 1000 pounds over for his vehicle and almost 1500 over for the axel. In this state if ticketed by the state patrol plea bargain is almost nil. I have no doubt that the overweight and accident probably gave him enough points to pull his license and insurance loss for points and at fault accident in this state is almost a financial death sentence when trying to get reinsured..

Also last month when pulled over at one of the random paper and safety check stops I had a load of concrete inside. They checked my placard and my tires then counted the bags and did the math on my load. Thank goodness for the guy doing the math because the supervisor was going to call for a scales person and I would have been waiting a long time on that. They did suggest that I take my van with a similar load to a scale sometime and get it verified just to keep me safe. I got a "very nice" for having correct tires and "a new bulb might be needed" for one of my rear side markers.
